APPLICANTS' RESPONSE TO BOARD's MEMORANDUM AND ORDER OF JANUARY 18, 1983 Responding to the Board's Memorandum and Order of January 18, 1983, Applicants propose to salvage and dispose of the meteorological tower. The exploratory trench was excavated pursuant to a mining permit issued by the State of Oregon.

Applicants propose to leave the exploratory trench and will comply with the State of Oregon's requirements for bank sloping and grass seeding in this regard. The meteorological tower is not in the path of a migratory bird flyway and has not caused bird mortalities to date. As the meteorological tower will be 8302160365 830204 PDR ADOCK 05000514 O PDR gh

removed within the near future, no permanent hazard to birds is envisioned.
