-lg AFFIDAVIT OF EDWARD A. SAWYER ON NECNP I.M EDWARD A. SAWYER, being on oath, deposes and says as follows:
1.
I as the Fire Protection Coordinator, employed by Yah' tee Atomic Electric Company. I am currently assigned to the Seabrook Project. My professional qualifications appear in Appendix C to Revision 1 of the Seabrook Station Fire Protection Program, Evaluation and Comparison to BTP APCSB 9.5-1, Appendix A.

In responding to the NECNP Interrogatories in support of Contention I.M.
it has been demonstrated that the Applicant has satisfied the requirements of GDC 3 as implemented by the Commission in applicable portior.s of CLI-80-21. The Applicant's fire protection program has been compared to 3TP APCSB 9.5-1, Appendix A, and the results of that comparison filed with 4
the NRC. In all cases, the program either meets the technical requirements of the BTP or provides equivalent alternate protection. This equivalent alternare protection has been reviewed and accepted by the NRC.
The fire protection program has also been compared to Appendix R to 10CFR50, Fire Protection Program for Operating Nuclear Power Plants. For those areas where the program differs frca the technical requirements of Appendix R, equivalent alternate protection has been provided. This comparison and provision of equivalent alternate protection has been reviewed and accepted by the NRC.
Therefore, the Applicant's fire protection program meets the requirements of GDC 3.
Based on the above, I feel there is no issue relative to NECNP Contention I.M on which factual hearings are warranted.
