In, 9ccordance with the disclosure requirements of the McGuire case, I am enclosing the Affidavit of Kenneth A. Ainger, dated February 10, 1983. Mr. Ainger's affidavit provides information pertinent to DAARE/ SAFE Contention 9a which, as limited by the Atomic Safety and Licensing Board, concerns the potential for a bubble collapse waterhammer in the feedwater bypass line similar to the one that occurred at the KRSKO plant in Yugoslavia.

The purpose of this filing is to apprise the Licensing Board and parties of two changes to the feedwater bypass system. As more fully explained in Mr. Ainger's affidavit, these changes are as follows:

1. In her affidavit, dated October 5, 1982, which was served on the Licensing Board and all parties by letter of counsel, dated October 14, 1982, Ms. Leslie A. Bowen stated

4 that Commonwealth Edison Company no longer intended to install temperature sensors on the bypass system piping. Edison has reconsidered this position and now intends to install such sensors.

2. In her prior affidavit, dated June 6, 1982, which was filed on June 7 3 1982 in connection with Edison's motion for summary disposition, Ms. Bowen stated that the Byron System design had a check valve upstream of the auxiliary nozzle which was not present in the KRSKO design.

(This valve was also referenced in Edison's response to questions posed by the NRC Staff with respect to the KRSKO event. A copy of this response was submitted to the Licensing Board and all parties by the aforementioned letter of counsel, dated October 14, 1982 as an attachment to Ms. Bowen's October 5, 1982 affidavit.) For reasons stated in Mr. Ainger's affidavit, and the letter from Westinghouse, dated February 9, 1983, attached thereto, this valve has been removed from the Byron Station design.
