Page l of 2 Notice of Violation 93-300-01 10 CFR 55.25 states, "If, during the term of the (an operator's) license, the licensee develops a physical or mental condition that causes the licensee to fail to meet the requirements of 55.21 of this part, the facility licensee shall notify the Commission within 30 days oflearning of the diagnosis. For conditions for which a conditional license (as described in 55.33(b) of this part) is requested, the facility licensee shall provide medical certification on Form NRC 396 to the Commission (as describe in 55.23 of this part)." Also,10 CFR 50.74 states, "Each (facility) licensee shall notify the Commission in accordance with 50.4 within 30 days of the following in regard to a licensed operator or senior operator:. (c) Disability or illness as described in 55.25 of this chapter."

Contrary to the above, on February 11,1993, and January 17,1989, the facility licensee's physician made the determination that the eyesight of two operators no longer met the minimum standards required by 55.33(a)(1) as measured by the standards of ANSI /ANS-3.4-1983. The facility licensee, in each case, failed to notify the Commission of the change in medical status of these operators within 30 days as required by 10 CFR 55.25 and 10 CFR 50.74.

II.

The Reason for the Violation,if Admitted During an internal audit that was requested by the Training department of operator medical records, plant personnel identified that proper NRC notification had not been made within the specified time restraints. The medical status for two licensed operators had changed which required NRC notification. The medical examiner had determined that the operators' visual acuity required a restriction to their individual licenses.

A subsequent review was performed to determine the scope of the deficiencies. Four other operators were also identified as having changes to their medical status without NRC notification. The earliest case was 1985. Each case was similar in that each operator had been diagnosed as needing corrective lenses.

The lack of a process to evaluate medical status changes and clearly designate them as reportable to the NRC was determined to be the cause of this incident. Reviews of the governing procedures revealed that instructions did not specifically address reporting changes in medical status oflicensed operators unless they were physically unable to perform theirjob.

Corrective Steps Which IInvc Been Taken and Results Achieved The proper reports were made to the NRC of medical status changes of the identified operators. The procedure that governs medical records was changed to require proper evaluation of changes, such that they will be reported within the proper time limitations. A responsible organization was designated to evaluate changes to medical status and appropriately report license restriction changes. Additionally, the plant reporting requirements procedure was revised to address notification of changes to medical status of licensed operators.

IV.

Corrective Steps to he Taken to Preclude Further Violations GGNS feels that the above corrective actions will preclude recurrence.
