(JamesA.FitzPatrickStationf REQUEST FOR A HEARING Pursuant to S2.105 (d) (1) of the Rules of Practice of the Nuclear Regulatory Commission, 10 CFR 52.105 (d) (1) (1978),
and the Notice of Proposed Issuance of Amendment to Facility Operating License issued on September 1, 1978, 43 Fed. Reg.
40580-81 (1978) Power Authority of the State of New York,
(" Authority"), as holder of Facility Operating License No. DPR-59 hereby requests a hearing with respect to its application for a Facility Operating License Amendment filed on July 26, 1978.
At the hearing the Authority will urge that the relief requested in its application for a facility license amendment i
be granted.
That application would authorize an increase in l
l l
spent fuel storage capacity from 760 to 2,244 fuel assemblies.
l The amendment wo 11d also revise design features and associated operating limits, as necessary, to accommodate the increased storage capacity.
The need for a hearing will be obviated if the Commission l
determines that the relief sought in the Application for an 7810300A80 t

i Amendment to Facility Operating License DPR-64 should be granted without change.
If the Commission so concludes, the instant request for a hearing is to be considered withdrawn.
If, however, any peticions for intervention are granted and j
a hearing ordered then the Authority will appear and participate h
l in such hearing in support of its amendment application.
