Dear Judges Brenner,

Cole and Morris, In response to an oral request made by Judges Cole l and Morris on Friday, October 1, 1982, I am writing to I inform the Board that at this time it is not possible for me to respond to the Board's order of June 1, 1982, requesting a status report and recommendations on the discovery process presently being carried out in the above-referenced proceeding. The report is due October 11.

l Having received reports from intervenors by September 30 on the status of their discovery attempts, I called NRC staff on October 1 to set up a procedure for preparing the report to the Board. A,nn Hodgdon of the staff stated

! that due to the hearing schedule set for the water issues, neither she nor anyone else on.the staff would be able to participate in preparing the report.

Counsel for the Applicant are in the same position.

Since it would be inappropriate for me to prepare the report without participation by both the NRC staff and

- PECO's counsel, l'he.reby request that the schedule for reporting on.the status of discovery be postponed until such time as all of the necessary parties are available.

Counsel for PEC0 have asked me to request that'the report not be required until November 22 or later, due to the briefing schedule for the water issues. NRC staff made

.o considerable time would be absorbed preparing briefs after the hearing on the water issues. I have no ob-jection to postponing the due date until after briefing is completed.
