MOTION OF GOVERNOR BROWN FOR EXTENSION OF TIME TO RESPOND TO SEPTEMBER 2, 1982 ORDER On September 2, 1982, this Appeal Board issued an Order requesting the parties to submit briefs no later than September 17, 1982 concerning whether issues presented by the pending appeals from the Licensing Board's low power decision (14 NRC 4

107 (1981)), have been rendered moot by the-Licensing Board's i

Initial Decision of August 31, 1982 on full power issues.

For the reasons set forth below, Governor Brown hereby moves the Board for a short extension of time in which to respond to the Appeal Board's inquiries.

The Governor's three counsel in the Diablo Canyon proceeding, Messrs. Brown, Lanpher, and Dynner, all have commitments during the coming week in connection with the Licensing Board proceeding on the Shoreham Nuclear Power Plant.

Mr. Brown must attend a security prehearing conference in the Shoreham proceeding in Bethesda on September 13 and negotiations with the applicant and other meetings scheduled in Long Island during the succeeding days.

Last week, Messrs.

Lanpher and Dynner were engaged in preparation for trial while Mr. Brown was in San Fransisco for meetings with the NRC Staff and consultants concerning the Diablo Canyon proceeding.

In view of these commitments, Governor Brown requests leave to file his brief in response to this Board's September 2 Order by September 24, 1982, with any reply to be filed by October 1, 1982.

The Governor suggests that the filing period for other parties be i

likewise extended to comply with the Board's Order that all briefs and reply briefs be filed simultaneously.
