STATEMENT OF THE COLUMBIA RIVER INTER-TRIBAL FISH COMMISSION IN SUPPORT OF INTERVENTION BY THE YAKIMA INDIAN NATION The Columbia River Inter-Tribal Fish Comission supports the Yakima Indian Nation petition to intervene in the Skagit/Hanford proceedings. The comission considers the potential contribution to the Skagit/Hanford proceeding The by participation of the.Yakima Indian Nation to be of paramount value.

Inter-Tribal Fish Comission does not, and could not, represent the discrete, individual position of the Yakima Nation.

Many aspects of the Yakima petition are germane only to representation l

! by the Yakima Indian Nation. These aspects include:

(a) the requirement to assure the Yakima Indian Nation and its people perpetual free access to all ceded lands; (b) the requirement to eliminate any potential need to evacuate or recomend evacuation of any of the Yakima peop10 from the Yakima reservation or ceded lands; (c) the requirement to design and construct the project to assure that the health of the Yakima Indian people or treaty reserved assets will not be threatened; and (d) the requirement that no aspect of the project would infringe upon the unique value system of the Yakima Indian Nation or any written or unwritten Yakima laws.

O comission acts only according to the consensus position of the fish and wildlife comittees of the four Columbia River treaty tribes so as to promote and coordinate their conservation practices. An essential aspect of promoting these conservation practices is to ensure that particular similarly held treaty rights are not rendered nugatory. Thus the comission has determined to intervene in the Skagit/Hanford proceedings.

The comission considers, building a sound record to be essential for the Skagit/Hanford permitting and licensing. Thus, the comission believes that the addition of the Yakima Indian Nation as a party would greatly assure the development of such a record in an orderly fashion.
