Dear Mr. Chilk:
By letter dated January 5,
- 1993, the New Jersey Department of Environmental Protection and Energy.("New Jersey" or "NJDEPE") requested that the Nuclear Regulatory Commission review the December 23, 1993 denial by the Director, Nuclear Material Safety and Safeguards, of the State's October 8,
1993 petition.
The State had requested that the NRC institute a proceeding to halt ongoing shipments of slightly irradiated fuel from Shoreham Nuclear Power Station to the Limerick Generating Station.
As recognized by the NJDEPE, such an appeal is not permitted under the Commission's rules.
10 C. F.R. S 2.206 (c) (2).
In the circumstances, PECO Energy Company (formerly Philadelphia Electric Company), the owner and operator of the Limerick Generating Station, will not respond to New Jersey's letter unless requested by the Commission.
