Decade's interrogatories were filed on July l
21, 1982, and the Staff responded on August 6, 1982.
Because the Staff noted in its answers that certain documents marked
" Westinghouse Proprietary" had not been provided to Decade, Decade noted in a letter dated August 10, 1982, to Mr. Bachmann, NRC Staff counsel, that Decade assumed its time to file its amendment to the Motion would not begin to run until it had received all of the documents.
Licensee thereupon called Mr. Anderson, indicating disagreement with Decade's assumption and stating Licensee's position that Decade's amendment was due to have been filed on August 16.
Because of the scheduling sensitivity in this proceeding, Licensee undertook to obtain the documents in question directly from Westinghouse and provided those documents to Decade, by hand delivery, on August 18, 1982.
Decade in turn agreed that it would file its amendment to the Motion, if any, by Federal Express on August 20, 1982.
