Dear Mr. Eisenhut:

By letter of January 28, 1981, in accordance with condition 3E(7) of the Vogtle Construction Permit, Georgia Power Company (GPC) submitted aquatic monitoring data and an evaluation of the environmental effects of the intake structure and canal due to fish impingement. GPC requested that review of the study be expedited to allow construction of the intake structure by March 1,1981.

To aid in expediting the review, GPC hereby submits copies of (1) a Water Quality Certification issued by the State of Georgia under section 401 of the Clean Water Act; and (2) a permit issued by the Corps of Engineers under section 404 of the Clean Water Act. Both of these documents contain conditions that GPC satisfy the State of Georgia re-garding the environmental effects of the intake structure due to fish impingement and entrainment under section 316 of the Clean Water Act.

The documents are being sent to demonstrate that environmental effects of the intake will be considered at the state ievel .

Pursuant to Section 401 of the Federal Water Pollution Control Act Amend-ments of 1972 (33 USC 1251,3141), the State of Georgia issues this certification to Georgio Power Company, on cpplicant for a Federci permit or license to f conduct on cctivity in, on or adjacent to the waters of the State of Georgia.

The State of Georgia certifies that there is no cpplicable provision of Section 301; no limitations under Section 302; no standard under Section 306; and no standard under Section 307, for the cpplicant's activity.

This certification is contingent upon the following conditions:

1. All work performed during construction will be done in a menner so os not to violate cpplicable water quality standards.
2. No oils, grease, materials or other pollutants will be dischcrged from the construction activities which recch public waters.
3. The opplicant will be required to demonstrate that the intake structure complies with cpplicable 316-b guidelines prior to use.

It is your responsibility to submit this certification to the oppropriate Federal agency.

f. That the permittee agrees thathewill prosecute the construction or work authorized harem in a manner so as to mmimite any degradation of water Quality.
g. That the permittee shall permit the District Engineer or h.s authorized representative (s) or designee (s) to make periodic mspections at any time deemed necessary in order to assure that the activity bemg performed under authority of this permit is in accordance with the terms and conc *itions prescribed herein.
h. That the permittee shalt mamtam the struoure or work authorized herein in good condition and in accordance with the plans and drawmgs attached hereto.
i. That this permit does not convey any property nghts, either m real estate or material, or any emclusive previleges;and that it does not authorize any mjury to property or mvasion of rights or any mfrmgement of Federal, State, or local laws or regulations nor doesit obviate the requirement to obtain State or iocal assent required by law for the activity authorized herein.
j. That this permit may be summareiv suspended, m whole or in part, upon a fmdmg by the District Engineer that immediate suspension of the activity author 2ed herem would be m the general public inte9st. Such suspension shall be effective upon receipt by the permittee of a written notice thereof which sha!I mdicate (1) the extent of the suspension. (2) the reasons for this action, and (3) any corrective or preventatsve measures to be taken by the permittee which are deemed necessary by the District Engmeer to abate immment hazards to the general public mterest. The permittee shait take immediate action to comply with the provisions of this notice.

Withm ten davs followmg receipt of this notice of suspension, the permittee may request a hearing m order to present ir* formation relevant to a decision as to whether his permit should be remstated, modifeed or revoked. If a hearmg is requested,it shall be conducted pursuant to procedures prescribed by the Chief of Engineers. Af ter completion of the hearmq, or withm a reasortable time after issuance of the suspension notice to the permittee af no hearmg is reouested, the permit we61 either be reinstated, modified or revoked.

k. That this perrr%t may be either modified, suspended or revoked m whole or m part if the Secretary of the Army or his authorized representative determmes that there has been a violation of any of the terms or Conditsorts of this permit or that such action would otherwise be en the public mterest. Any such modification, suspension, or revocation shall become ef fective 30 days after receipt by the permittee of wntten tsotice of such action which shall specify the facts or conduct warrantmg same unless (1) within the 304ay period

If, subseouent to the issuance of this permit, such information and data prove to be false, incomplete or inaccurate, this permit may be modified, suspended or revoked, in whole or m part, and/or the Government may. in addition, mstitute appropiiate legal oroceedmgs.

STRUCTURES IN OR AFFECTING NAVIG ABLE WATERS OF THE UNITED STATES:

a. That this permit does not authorite the interference with any existing or proposed Federal project and that the permittee shall not be entitled to compensat.on for damage or miury to the structures or work authorized herein which may be caused by or result from

, esisting or future operations undertaken by the United States in the pub 4 interest.

b. That no attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or edi acent to the activity authorized by this permit.
c. That if the display of Inghts and signals on any structure or work authorized herein is not ctherwise provided for by law, such leghts and segnais as may be prescribed by the United States Coast Guard shall be mstalled and mamtamed by and at the expense of the perm.t tee.
d. That the permittee, upon rece.pt of a notice of revocation of this permit or upon its empiration before cornpletion of the authorised structure or work, shall, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may detect, restore the waterway to its former conditions. If the permittee fa.Is to comply with the detection of the Secretary of tne Army or his authoriJed representative the Secretary or his designee may restore the waterway to its former condition, by contract or otherwise, and recover the cost thereof from the pertnettee.
e. Structures for Small Boats; That permittee hereby recognizes the possibehty that the structure permitted herein may be subiect to damage by wave wash from pass.ng vesseis. The issuance of this permet does not rel. eve the permittee from taking all proper steps to ensure the integrety of the structure permitted herein and tne safety of boats moored thereto from damage by wave Wash and the permittee shall not hold the United States hable for any such damage.

MAINTENANCE OREDGING

a. That when the work authorige f hereen mcludes periodic mamtenance dredgmg, it may be performed under this permit for years from the date of issuance of this permit (ten years unless otherwise indicated);
b. That the perrnittee will advise the District Eng.neer m writing at least two weeks before he mtends to undertake any maintenance dredging.

This permit shall become effective on the date of the District Engmeer's segnature.

Any and every master pilot, and enginecr, or person or persons acting in such capacity, respectively, on board of any boat or vessel who shall knowingly on- ,

gage in towing any scow, host, or vessel loaded with any material specified in section 407 of this titic to any point or picce of deposit 'or discharge in any

harbor or navigabic water, ciscwhere than within the limits defined and permit-t ted by the Secretary of the Army, or who chall-w'111fn11y injure or destroy any work of the United States contemplated in section 408 of this title, or who shall willfully obstruct the channci'of any m eerway in;the manner contemplated L
