The Commission (with all Commissioners agreeing) has agree ~d to the renewal of ACNW members and the plans to stagger appointment i

renewals contained in your June 1,

1992 memorandum to the i

Commission with the following changes:

o Current members of the ACNW should be considered to have just completed their initial appointments under the new Commission

policy, are now beginning their first reappointment and will be eligible for one additional reappointment.

o Dade W.

Moeller and Martin J. Steindler are reappointed for a one-year term to end in June 1993 and remain eligible for one additional reappointment for a two-year tern which would end in 1995. That would provide a total of seven years service for each of these individuals.

William J. Hinze and Paul W. Pomeroy are reappointed for a two-year term to end in June 1994 and remain eligible for one additional reappointment which would end in June 1996.

o The Commission does not delegate the authority for reappointments, but instead, will review the appointments j

of two ACNW members each year (rather than four, as has been the practice heretofore).

Advisory Committee on Nuclear Waste (ACNW) 2.

The Committee's objectives, scope of activities and duties are as follows:

The Committee shall report to and advise the Nuclear Regulatory Commission (NRC) on nuclear vaste managementgas directed by the Commission on the basis of periodic Y5fi'ess

of ACNW proposals.

This includes 10 CFR Parts 60, 61, and 72 (as applied to other than the site of production and utilization facilities) and other applicable regulations and legislative mandates such as the Nuclear Waste Policy Act, the Low-Level Radioactive Waste Policy Act, and the Uranium Mill Tailings Radiation Control Act, as amended.

The primary emphasis will be on disposal but will also include other activitie's of f-site of production and utili' 3 tion facilities, such as handling, processing, transportation, storage, and safeguarding of nuclear wastes inc); ding spent fuel, nuclear vastes mixed with other hazardous substances, and uranium mill tailings.

In performing its work, the Committee will examine and report on those areas of concern referred to it by the Commission or its designated representatives, and will undertake other studies and activities on its own initiative related to those issues directed by tte Commission.

The Committee will interact, with representatives of NRC, ACRS, other Federal Agencies, State and local agencies, Indian Tribes, private organizations, etc., as appropriate to fulfill its responsibilities.

The committee's official designation:

Advisory Committee on Reactor Safeguards (ACRS) 2.

The committee's objectives and the scope of its activity:

a)

Section 29 of the Atomic Energy Act of 1954, as amended, provides:

"There is hereby established an Advisory Committee on Reactor Safeguards consisting of a

maximum of fifteen members j

appointed by the Commission for terms of four years each. The i

Committee shall review safety studies and facility license l

applications referred to it and shall make reports thereon, shall advise the Commission with regard to the hazards of proposed or existing reactor facilities and the adequacy of proposed reactor safety standards, and shall perform such i

other duties as the Commission may request.

One member shall -

l be designated by the Committee as its Chairman.

The members of the Committee shall receive a per diem compensation for each day spent in meetings or conferences, or other work of the Committee, and all members shall receive their necessary traveling or other expenses while engaged in the work of the Committee.

The provisions of Section 163 shall be applicable i

to the Committee.

In addition to its other duties under this section, the Committee, making use of all available sources, shall undertake a study of reactor safety research and prepare and submit annually to the Congress a report containing the results of such study."

Section 182 b.

of the Atomic Energy Act of 1954, as i

amended, provides:

i "The Advisory Committee on Reactor Safeguards shall review' each application under section 103 or section 104 b.

for a construction permit or - an operating license for a facility, any application under section 104 c. for a construction permit or an operating license for a

testing

facility, any application under section 104 a. or c. specifically referred to it by the Commission, and any application for an amendment to a construction permit or an amendment to an operating license under section 103 or 104 a.,

or c. specifically referred to it by the Commission, and shall submit a report thereon which shall be made part of the record of the application and available to the public except to the extent that security classification prevents disclosure."

Chapter 21, Section 313(f), of the Atomic Energy Act of 1954, as anended (by Public Law 100-456, The National Defense Authorization Act, Fiscal Year 1989), established the Defense Nuclear safety Board and provides that:

"With the consent of and under appropriate support arrangements with the Nuclear Regulatory Commission, the Board may obtain the advice and recommendations of the staff of the commission on matters relating to the Board's responsibilities and may obtain the advice and recommendations of the Advisory Committee on Reactor Safeguards on such matters."

d) 10 CFR 1.13 provides that the ACRS:

t upon request of the Department of Energy (DOE),

reviews and advises with regard to the hazards of DOE nuclear activities and facilities; reviews any generic issues or other matters referred to it by the Commission for advice.

The Committee, on its own initiative, may conduct reviews of specific generic matters or nuclear facility safety-related items."

The Energy Reorganization Act of 1974, as amended by Section 6 of Public Law 95-209, added the ACRS Fellowship Program providing that:

"To assist the ACRS in carrying out its

function, the Co=itt ee shall establish a fellowsh'p program under which persons having appropriate engineering or scientific expertise are assigned particular tasks relating to the functions of the Couittee.

Such f ellowships are for two-year periods and the recipients of such fellowships shall be selected pursuant to such criteria as may be established by the Committee."

Committee's Obiectives, Scope of Activities, and Duties On a continuing basis, NSRRC will provide advice to the Director of the Office of Nuclear Regulatory Research and.

through him the Commission, on matters of overall management importance in the direction of the NRC's program of nuclear safety research.

Matters requiring NSRRC's attention will I

be posed by the Director of the Research Of fice, or as an outcome of prior NSRRC deliberations.

Nuclear safety i

research is understood to encompass technical investigations of the implications for public health and safety of the peaceful uses of atomic energy and the reduction of those investigations to regulatory practice.

NSRRC activities will include assessment of and recommendations concerning:

to the NRC Philosophy of Nuclear Regulatory Research, as stated in the Commission's Strategic Plan, and to r

specific Commission directions.

Likelihood of the program meeting the needs of the users of research.

and the correctness of their direction.

7hether the best people are doing the work at the best places; whether there are other options, including cooperative programs, that would yield higher quality work, or otherwise improve program efficiency.

In addition, NSRRC will conduct specialized studies when requested by the Commission or the Director of the office of Nuclear Regulatory Research.

If appropriate, these studies will be published as reports.

Estimated Number and Frequency of Committee Meetinos The Committee will meet at such times and places as it deems necessary, but not less than once a year.

Subcommittees may meet as deemed necessary to achieve their assigned tasks.
