Dear Commissioners:

Re: Dockets #50-247, 50-286 On June 15 we sent to the Commission a motion in support of a show cause order requesting that Indian Point generating units #2 and #3 be shut down.

In your Memorandum and Order (CLI-82-15) of July 27, 1982, no mention is made of above motion or that of one sent to you by the County of Rockland. We append a copy of ours.

Pursuant to 10 CFR 2.206 (a) we are also sending a copy to the Director of Nuclear Regulation.

We have not commented sooner on the Commission's action taken to restrict the hearings in Special Proceedings

  1. 50-247 and #50-286. We now wish to thank you for your un-timely interdiction. Many residents of Rockland County have not believed in the whole structure of NRC/ FEMA / Licensees and had vague uneasiness about the lack of opportunity for those affected to have any choice. Your cancellation of testimony already taken, and the tardiness of your objec-tions to the April 23 Order of the ASLB amazed the legal fraternity especially, as well as many others.

It is clear that you do not wish to deal with the public. The warnings on page 8 of Commissioner Asselstine's dissent about the public perception are abso-lutely on target. The public does not agree that others and officials of Rockland County who have already testified are to be forgotten. We can't imagine what you could now do to regain the confidence of the people excepting to suspend or remove the licenses of the two stations. l Very truly yours, fijorahS.5? AND IN SUPPORT OF FOE /AUDUBON ' S RESPONSE TO SAME OF JUNE 8, 1982 On June 4 and on June 8 above responses were made before the Commission by UCS, NYPIRG, FOE and AUDUBON, and before the ASLB moving for reconsidera-tion of the Commission's ruling permitting interim operation of Indian Point Units #2 and #3 pending the outcome of the present ASLB investigation, and for issuance of a show cause order against the Licen-l sees prior to commencement of the evidentiary portion of the above captioned investigation.

Since the UCS/NYPIRG and the FOE /AUDUBON/WES-PAC motions offered new evidence even more has now surfaced. Indian Point Unit #3 is "down" and inspec-

tion reveals that corrosion of the steam generator tubes is such that they would not fit into the standard set by Amendment 69, and that any petition for further amendment would be of major proportions if not double the percentage of plugged tubes. Therefore, a major defect now exists and could only be remedied by a vast expnsdhure of replacement of parts. The shells of the steam generators have cracks in them and it is a mercy that the plant shut down when it did in March.

The corrosion and its results are even worse than the Commission had anticiptaed and the f act that the plant is down illustrates that it is less safe than the Commission realized heretofore by the doubling of Amendment 69's tolerance.

Sleeving is but a temporary repair, if attempted, and does not eliminate the cause of corrosion but may, if anything, exacerbate it. Nor can the hid1 velocities and possible pressure variations at one end of the tubes be changed due to design of the generators. Patching or replacement are not safe options because the replace-ment generators could also fail long before their re-cuired life expectancy.

We urge the Commission to quit while it is ahead by ordering the abandonment of the Indian Point Electric generating units through a show cause order and interim suspension before many more dollars are spent studying bandaids to keep the licenses in effect.
