Field Office of Investigations, Region II, confirming a telephone conversation on March 31, 1993, relating to the D0J decision to close the criminal investigation concerning alleged misrepresentations _made to the NRC by Southern Nuclear regarding the Plant Vogtle diesel. generator issues..

This information is being brought to the attention of the Commission, the' Licensing Board and All Parties as information'which may be relevant and material to issues pending befor the Commission and Licensing Board.

Dear Mr. Vorse:

This letter will serve to confirm our telephone conversation on March 31, 1993, in which I advised you that our office has decided to close the criminal investigation concerning alleged misrepresentations made to the NRC by Southern company related entities and individuals regarding the Plant Vogtle diesel generator issues.

We recommend that the NRC continue to pursue this matter administratively.

However, as I indicated, should sufficient facts develop in your administrative proceeding that would lead us to believe that it would be appropriate to reopen the criminal investigation, it is certainly possible that we might choose to do so.

If you have any questions, please do not hesitate to contact me.
