OF PUBLIC MEETINGS ON BELOW REGULATORY CONCERN POLICY

Purpose:

This paper forwards for Commission approval the final NUREG report which summarizes the public meetings held by the NRC staff to present the Below Regulatory Concern Policy Statement and obtain statements from members of the public.

Background:

Following publication of the Below Regulatory Concern Policy Statement in the Federal Register (55 FR 27522),

the NRC published a notice of public meetings to be held in the vicinity of each of the five NRC regional offices.

The meetings were to enable NRC staff members to discuss the policy with attendees, hear statements from the public, and answer questions about the policy.

NRC licensees, Agreement State licensees, government officials, and interested members of the public were encouraged to attend. A brief summary of the public meetings was forwarded to the Commission on October 3, 1990, as SECY-90-339.

Discussion:

During the public meetings held to discuss the Below l

Reguletory Concern Policy Statement, the staff indicated l

that it would prepare a summary of the meetings and make that summary available to members of the public. Each of the meetings was transcribed, and a number of written statements were submitted by attendees.

The staff has developed the enclosed NUREG report which provides the summary of the BRC public meetings.

The NUREG is divided into three sections dealing with the NRC presentations of the policy, the issues raised in the

statements made by attendees and NRC responses te those issues, and the questions submitted to the NRC staff during the meeting with the responses provided by the NRC

The presentations made by the NRC staff (Section I) include the opening presentation made by Dr. Malcolm R. Knapp at the meeting in King of Prussia as representative of the opening remarks made at each meeting, and the presentations made by Dr. Donald A. Cool and Mr. John W. N. Hickey on the policy statement and its implementation.

The summary of the issues (Section II) is a condensation of the issues raised by numerous speakers and does not represent the particular statements of any given individual or group.

The summary of questions and answers (Section III) consists of the written questions received during the meeting and answers by the NRC staff as given at the public meetings, with editorial adjustments made to the transcript only to clarify the record.

An Appendix to the NUREG contains the Federal Register notices that announced the time and location of the meetings, the agendas for each of the meetings, copies of the lists of speakers for each meeting, and copies of written submissions received during the meeting.

Coordination:

The Office of the General Counsel has no legal objection to this paper.

Recommendation:

The staff plans to publish this NUREG for distribution to members of the public in 2 weeks unless the Commission indicates otherwise.

Copies of the NUREG will be placed in the Public Document Room and copies will be provided to meeting attendees who provided their names and addresses.
