Dear Administrative Judges:
The purpose of this letter is to inform the Appeal Board of recent information-1 received by Staff Counsel concerning consideration by the ACRS Subcommittee'on Reactor Operations of certain issues referred to the ACRS by the Ucensing Board in the i
l above-captioned proceeding.
By letter. of November 1,1990, I informed the Appeal:
Board that, contrary to the Staffs. initial understanding, the Subcommittee on Reactor. '
p Operations had decided to consider those issues. Therefore, Staff Counsel believed that -
some clarification of a statement made in its brief filed in this proceeding before the Appeal Board on October 22,11990,' was necessary.
- On November 14,1990,.I was informed (by telsphone) by Mr. Raymond Fraley,;

-Executive Director of the ACRS, that during a recent ACRS meeting, the Subcommittee on Reactor Operations had decided not to consider the issues after all. Therefore, I am.
writing to apprise the Appeal Board that, as of this time, it is the Staffs understanding:

that neither the ACRS nor any subcommittee of the ACR$ intends to consider the issues 3
referred to the ACRS by the Ucensing Board in this proceeding in its order of September 5,1990.
