ORDER The Licensing Board has received from Del-Aware Unlimited, Inc. a request for issuance of subpoenas to a number of individuals as to whom it had previously given notice of deposition. The Applicant opposes the issuance of subpoenas to Gerald M. Hansler, George Pence, and Commissioner William Marazzo.
The Board essentially agrees with the Applicant that there has been no showing of relevance of the information sought from Commissioner Marazzo, but does not accept the Applicant's arguments with regard to subpoenas to the other individuals.
As requested by Del-Aware and upon a showing of the general relevance of the information sought, the Licensing Board is issuing subpoenas requiring the following individuals to appear for deposition:

Hr, George Pence Dr. Robert Dresnack Dr. Thomas May Mr. William Major Mr. Harold Brundage Mr. Hershel Richman Mr. Gerald M. Hansler The Board has been informed by counsel for Del-Aware that the following individuals have appeared for deposition voluntarily and that subpoenas for them, although previously requested, are unnecessary:
-Mr. E. N. Bourquard Mr. Paul L. Harman Employee of E. H. Bourquard f
Assoc., Inc. responsible for velocity and hydraulics The requests for subpoenas for these individuals are therefore moot.
In addition, Del-Aware has requested that Robert Flowers and the NWRA official responsible for financial planning be subpoenaed for deposition.
The Board finds that there has been no showing that these individuals can provide information generally relevant to Del-Aware's contentions in this proceeding. Accordingly, subpoenas for Commissioner Marazzo, Robert Flowers and the NWRA official responsible for financial planning are denied.

The subpoenas which are being issued shall be served on the individual being subpoenaed not later than four (4) calendar days before the deposition is scheduled unless the individual being subpoenaed is aware of the scheduled deposition and has agreed to receive the subpoena at some tide closer to the commencement oi the deposition.
IT IS 50 ORDERED.
