ORDER GRANTING NRC STAFF MOTION e OF DECEMBER 8, 1978 FOR EXTENSION OF TIME

On December 8, 1978 the NRC Staff filed an "NRC Staff Motion for an Extension of Time" to file a motion to compel responsive answers to its "First Set of NRC Staff Interrogatories to the County of Suffolk" (which was dated May 15, 1978). The County of Suffolk had served the report of the MH3 Technical Associates on November 30, 1978 with the expressed belief that the report

( ', , eliminated the need for a particularized response to l Staff's interrogatories. The NRC Staff, however, does not I-l share the County's view that the MEB report is an adecuate I,

response to its interrogatories. l Staff is seeking an extension of time because it l cannot review the extensive catarial submitted by the County of Suffolk and prepare a motion within the 10 days allowed ,

by the Commission's Rules of Practice. Additionally, both Staff counsel assigned to this proceeding will be out of Washington during much of the month of December, 1978.

Therefore Staff requests an extension of time until January 12, 1979, within which to file a motion to compel responsive answers to its interrogatories.

The Board conducted a conference call with all parties on December 11, 1978. No objection was made to d, Staff's motion.

For good cause and absent any obj ection, Staff's motion for an extension of time until January 12 to file a motion to compel is granted.
