e LILCO's Response to the Board's November 8 Letter In the Matter of Long Island Lighting Company (Shoreham Nuclear Power Station, Unit 1)

' Gentlemen:
y On' October 8,1990, the Board asked the NRC Staff, LILCO, and Petitioners Shoreham-.
Wading River Central School District and Scientists and Engineers for Seure Energy, Inc.,
' "whether there is reason for the Licensing Board not to proceed with deciding the petitions at this time, taking into consideration petitioners' unresolved request for reconsideration of CLI 1
- 08."- The Board asked should it "not go forward with a review of the petitions, full or partial, before petitioners' appeal has been decided?"
i LILCO believes that the Board need not and should not wait for the Commission's disposition of Petitioners' October 29 request for reconsideration, but should proceed to rule on each of Petitioners' pending requests for hearing in'a manner consistent with CLI-90-08.
On a related matter, LILCO also understands that the Board will notify the parties as to its desire for further response to Petitioners' Motion for Restraining Order and Other Relief,-

However, on November 13 the Board's secretary telephoned counsel for LILCO (and other parties) with a message concerning the Board's disposition of the emergency aspects of Petitioners' Motion. On the basis of that message LILCO understands that the Board will issue guidance on further response to the Motion, and, accordingly, intends not to file further until rece.pt of such guidance.
