EXEMPTION TO 10 CFR 0.735-21 The Regional Counsel reviewed your confidential Statement of Employment and Financial Interest (Form NRC 269) and noted that you report, as a former employee of Vermont Yankee Nuclear Power Corporation, a vested interest in their pension plan.
In order to allow you to work on matters involving Vermont Yankee, an exemption from the provisions of 10 CFR 0.735 21 must be granted.
A review of the terms of the pension plan by the Office of General Counsel has revealed that as an NRC employee you cannot influence, in any fashion, the amount you receive as a pension from Vermont Yankee. Based upon this finding, I have determined that your interest in the pension plan is not so substantial as to be deemed likely to affect the integrity of your services to the NRC and that no provision of law and no NRC regulation would appear to oc violated by your participation in matters affecting Vermont Yankee.
l Therefore, with the concurrence of the Office of General Counsel, you are hereby grantr' exemption from the requirements of 10 CFR 0.735 21 and you may participate in matters before the NRC affecting Vermont Yankee. However, to avoid any implications of impropriety, I encountge you and your management to avoid assignments to Vermont Yankee involving independent inspection or functioning as Chief Examiner or Inspection Team Leader.
Please retain a copy of this document and include a copy of it with each year's disclosure report,
