DOCKET NO. 50-99 i By application dated July 23, 1981 as supplemented by letters dated September 1 23, October id, and November 23, 1981 and April 23, 1982, the Babcock and Wilcox Company (the licensee) requested that Facility License No. R-47 be

, terminated following completion of dismantling the Lynchburg Pool Reactor (LPR).

The reactor has been dismantled and disposed of in accordance with the licensee's dismantling plan and our dismantling order dated January 11, 1982. The Nuclear Regulatory Commission's Region II inspected the facility on May 25-26, 1982 and verified that dismantling had been accomplished in accordance with the dismantling order. Also, our ir.nec+.or conducted a radiation survey of the reactor facility and determined that the surface catamination met the criteria of Table 1 in Regulatory Guide 1.86 and that gamma radiation from reactor generated radionuclides was less than 5 microR/hr abwe natural background, as measured at one meter from a surface. The NRC radiation survey thus con-firmed that the dismantled facility met the criteria given on page 1 of the

~ licensees Dismantling Plan dated July 23, 1981 dnd accepted by the NRC.

The LPR fuel has been shipped to the DOE Savannah River Plant for reuse or reprocessing.

We have concluded that the termination of this license involves an action, which is insignificant from the standpoint of environmental impact, and pur-suant to 10 CFR 51.5(d)(4), that an environmental impact statement or negative declaration and environmental impact appraisal need not be prepared in connection with the issuance of this termination order.

Based on the reasons discussed above, we have concluded that this license termination is in compliance with the Commission's regulations, that there is reasonable assurance that this license can be terminated without endangering i the health and safety of the public and that its termination will not be li inimical to the coninon defense and security or to the health and safety of i the public.
