REPORT OF TUGCO, et al., - NOVEMBER, 1978,_.~
I Pursuant to the direction of the Atomic Safety and
(
Licensing Board during the Special Prehearing Conference er.
June 21, 1978 (T.R. 124-125), TUGCO submits this report on discovery during the month of November, 1978.
On November 22, 1978 the Department of Justice served its "First Set of Interrogatories and Request for Production of Documents From the Department of Justice to Houston Lighting &
Power Company and Texas Utilities Companies".
Because the request combines interrogatories and requests for production, k*
there is an ambiguity with regard to the response date in that the Comminsion's rules provide 14 days for responses to the former and 30 days for responses to the latter.
We have agreed with the Department's counsel that the time for responses or objections to the combined requests (unless extended under the Coomission's rules) shall be taken to be the 30-day period which expires December 22, 1978.
We would appreciate the Board's approval of that agreement.
There remains pending the Depart-I ment's informal request for background regarding certain

privilege claims; although our response has taken longer than initially thought, we now believe that we will be'in a position to respond to this informal request in the near future.
Also during the month of November, arrangements were made and implemented to permit inspection and copying of documents by representatives of the City of Brownsville.
Otherwise, TUGCO, et al., did not initiate or receive; nor was it consulted regarding, any discovery requests during the month of November.
