Dear Chairman Bowers:

On October 12, 1978, the Board issued an " Order Relative to a Discovery Schedule and therein provided that if, on October 24, 1978, the Suffolk County Legislature should approve addi,tional funding of the County's consultants in this case, MHS Technical Associates, the County is directed to file-its responses to interrogatories by November 13, 1978.

J' This is to advise that the County will not be able to v comply with the November 13 date. Although the County Legislature did indeed pass a resolution on October 24 calling for MH3 to prepare a report finalizing the County's cente ations , and pro-viding the basis therefore, MH3 was not able to begin work on that date. After a resolution is passed by the Legislature, the Suffolk County Executive has fifteen days w.ithin which to exer-cise his veto power.on legislation. As a result of this contin-gency, the County Clerk's office was not able to forward a certified copy of the resolution to MH3 until the ea"ly part of this past week. MHB was understandably reluctant to begin work on the project until it had received official written confirmation authorizing them to proceed.

Our office today spoke with Mr. Dale Bridenbaugh of

. MHB. Mr. Bridenbaugh advised that although MH3 has still not I received a certified copy of the County Legislature's reso-lution they would nevertheless begin work on the Shoreham report and would forward this document to me by not later than November 22, 1978. I thus anticipate, allowing for mail

. delivery, review and reproduction, that I will be able to serve this document on the Hearing Board and parties by November 30, ~
