MEMORANDUM November 21, 1978 We have received intervenor's " Petition for Directed Certification" to review the Licensing Board's rejection of Mr. D. D. Comey as an expert witness on security matters.
The petition was served by mail on November 20, 197b.
Under the Rules of Practice, as amended May 26, 1978, the applicant has 15 days and the staff 20 days to respond (including the additional 5 days allowed because the petition was served by mail).
See 10 C.F.R. HE2.710 and 2.730 (c).
The applicant's response is thus due to be served no later than December 5th and staff's by Monday, December lith.

2-Because of the apparent immediacy of the problem sought to be rectified by the petition, this Board will look with disfavor on requests to enlarge the time for responses beyond that allowed by the Rules of Practice, just described.
