DEPARTMENT OF JUSTICE MOTION FOR EXTENSION OF TIME 1.

Pursuant to Section 2.711 of the Commission's Rules of Practice, the Department of Justice (Department) hereby

moves for an extension of time to and including November 27, 1978, within which to file its reply to Ohio Applicants' Comments on the Statute Requiring Certification of Exclu-sive Service Territories for Electric Light Companies (Applicants' Comments). 1/

On October 13, 1978,- the Ohio Applicants in the above-styled proceeding requested this Atomic Safety and Licensing Appeal Board (Appeal Board) to take judicial notice of Ohio House Bill No. 577, which was described 1/

The NRC Staff and 'the City of Cleveland have informed the Department that they intend to file their responses by-November 20, 1979.

By Order dated October 20, 1978 this Appeal Board requested j

Applicants to submit answers to certain questions pertain-ing to this legislation by November 3, 1978.

Other parties were given an opportunity to reply by November 20, 1978..

In spite of diligent efforts to prepare a response to Applicants' Comments, which we filed on November 3, 1978, the undersigned counsel now find it virtually impossible to file a response by November 20, 1978 because of the necessity of devoting their full time and attention to the

Counsel for the Applicants, the NRC Staff and the City of Cleveland have authorized the undersigned counsel s

for the Department to state that they have no objection to granting'the requested time extension.
