REPORT OF THE DEPARTMENT OF JUSTICE - OCTOBER, 1978 Pursuant to the crder of the Atomic Safety and Licensing Board of June 21, 1978, the Department of Justice (Department) submits this report on the progress made in completing discovery during the month of October.

On October 10, the Department filed its RESPONSE OF DEPARTMENT OF JUSTICE TO APPLICANT'S FIRST REQUEST FOR __

PRODUCTION OF DOCUMENTS AND ANSWER TO INTERROGATORIES. < .

These initial responses encompassed some 52 pages and .- ,

several packages of pertinent documents. As the Depart- y ment continues its process of reviewing discovery materials 3

it will update its responses to Houston Lighting and Power's FIRST REQUEST FOR PRODUCTION OF DOCUMENTS AND ANSWERS TO INTERROGATORIES.

The Department received, on October 12, copies of the discovery materials it had designated for reproduction during the week of September 11-15, at the Dallas and Fort Worth offices of Texas Utilities and its operating subsid-iaries.

During the week of October 23-27, the Department reviewed additional discovery materials at the offices of 4

(}'; Houston's Washington counsel, received from the firm of Baker & Botts a description of privilege claimed relative to its production of documents for the Department's inspection, and provided assistance to the City of Browns-ville's counsel, Spiegel and McDiarmid, relating to Texas Utilities' discovery materials.

Throughout the entire month of October, the Depart-ment continued its process of reviewing discovery materials already received and preparing its own discovery requests.
