DPR-52 We have reviewed the Nuclear Regulatory Commission's (NRC) indemnity fee invoice numbers 23-79 and 27-79, dated October 24, 1978, and they appear to be incorrect. The August 1, 1977, amendments to 10 CFR Part 140 implementing legislation amending the Price-Anderson Act, as noticed in the January 3,1977, Federal Register (42 FR 46), reduced the indemnity fee based on che level of indemnification provided.
As of August 1978 there are 65 operating reactors which should reduce the required indemnification to the range of $99 million to $1 million which, in accordance with 10 CFR Part 140.7(5), results in a fee of
$6 per MW(t). Therefore, we request you review our invoice and provide us with a corrected invoice based on the appropriate fee.
