(Con Edison) transnits herewith three (3) sigrai originals and ferty (40) copies of a dmnant entitled " Application for headre.nr. to Operating License," sworn to en November 3, 1978. This Application requests an amendment to the Technical specifications for Indian Point Chit No. 2. The proposed Technical

Specification changes, contained in Attachment A to this Application, j
would establish limiting conditions for operation (ICOs) and surveillance i
requirenents for the recently i:tstalled Indian Point Unit No. 2 Overpressure Protection' System (CPS) in response to Mr. A. Schwencer's August 28, i
1978 letter to Mr. William J. Cahill, Jr. A Safety Evaluation of the proposed changes is presented in Attachnent B to this Application.

Based on plant design and cperational experience to date, Con Edison Miwes that the use of a pressurizer bubble durig startup of
_the-Anitial reactor coolant pmp (PCP) significantly reduces the effects

. In accordance with 10 CFR 170.22, this Acplication has been detened to be CIASS III, as it involves a single issue and has been desned not to involve a significant hazards consideration. Therefore, as required by regulation, enclosed is a check in the amount of S4,000.00 as the filing fee. This payment is being nede under protest, and Con Ed.ison reserves the right to challenge the validity of the irnacsition of these fees and the basis for the determination of the ancunts of the fms.
