LIMERICK GENERATING STATION UNITS 1 AND 2 - NRC INVESTIGATION REPORT NO. 1-2019-011 AND NOTICE OF VIOLATION
Dear Mr. Hanson:
This letter refers to an investigation conducted by the U.S. Nuclear Regulatory Commission (NRC) Office of Investigations (OI) at the Exelon Generation Co., LLC (Exelon) Limerick Generating Station (Limerick). The investigation, which was completed on October 19, 2019, involved security matters that are considered sensitive information. Therefore, details of the investigation are not included in this letter but are described in the non-public enclosures.
Based on the results of the NRC OI investigation, the NRC determined that a Severity Level IV violation of NRC requirements occurred. After considering the factors set forth in Section 2.3.2.a of the Enforcement Policy, this violation is being cited in the enclosed Notice of Violation (Notice). The details of the violation, including the assessment of its significance and the basis for citing the violation, are provided in Enclosure 1, and the Notice is provided as Enclosure 2.
The NRC notes that Exelon took immediate corrective actions to address any security-related vulnerability.
You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. If you have additional information that you believe the NRC should consider, you may provide it in your response to the Notice. The NRC review of your response to the Notice will also determine whether further enforcement action is necessary to ensure compliance with regulatory requirements.
In accordance with Title 10 of the Code of Federal Regulations (10 CFR) Part 2.390 of the NRCs Rules of Practice, a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room and from the NRCs Agency-wide Documents Access and Management System (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html. However, the material enclosed herewith contains Security-Related Information in accordance with 10 CFR 2.390(d)(1), and its disclosure to unauthorized individuals could present a security vulnerability. Therefore, the material in the enclosures will not be made available electronically for public inspection in the NRC Public Document Room or from ADAMS. If Security-Related Information is necessary to provide an acceptable response, please mark your entire response Security-Related Information in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1). In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response.
