4 This is an affirmation discussion session, and 5 I will ask the Saoretary to point to the items on the 6 agenda.

7 NB. HOYLE Mr. Chairman, we have one item for 8 affirmation today, all of the others have come off for 9 one reason or another, that item is 82-270A, Alternative 10 Commission Decision in Indian Point Special Proceeding.

11 That paper proposes an order, Mr. Chairman, that 12 responds to savarsi requests by parties to the Indian 13 Point proceeding, and provides additional guidance to

14 the Board.

15 Before I ask you to affirm the votes I have 16 received on that, I v'ould like to address another 17 matter.

18 You have received two submissions, one from 19 the Power Authority of the State of New York, and the 20 other from UCS-NYPIRG commenting 'on the Commission's 21 consideration of the draft order.

22 The question is, how do you wish to treat 23 those? The situation is, I now have three votes 24 suggesting that you do not want to entertain those 25 submissions.

4 July 19, but' have not entertained either le tter." I 5 would suggest that this be.the approach that you take, 6 and to modify the order.

7 COMMISSIONER AHEARNE: That is fine with me.

8 MR. HOILE We have agreement to do that, Mr.

9 Chairman. So the voting on the order is as follows:

10 the Chairman, Commissioners Ahearne and Rob erts approved 11 the version of the order circulated by Commissioners 12 Ahe,arne and Roberts on July 15th.

13 Commisssioners Gilinsky and Asselstine have

% 14 approved that order in part, and have disapproved it in 15 part, and indicated tha t they will provide separate 16 views.

4 MR. H0YLE: Yes, sir, normally you would wait 5 until the separata' views are available and attach them.

6 CHAIRMAN PALLADINO: Is there any problem 7 than?

8 MB. H0YLE: I don't see any.

9 COMMISSIONER AHEARNE: You don't know when 10 Vic's views are going to be available.

11 CHAIRMAN PALLADINO: Another approach we could 12 take is to publish the majority opinion tomorrow or 13 Monday, with a notation that other additional views, if

14 any, would be issued separately.

15 COMMISSIONER AHEARNE: I think to do that on 16 Monday would be fine.

17 CHAIRMAN PALLADINO: Let's see if we can't get 18 word to Commissioner Gilinsky that we would appreciate 19 his comments by tomorrow, so that we act on Monday, and 20 give all the Commissioners a chance to see the 21 additional comments, and wait until Monday.

22 COMMISSIONER AHEARNE: The order that we 23 affirmed actually was circulated almost a week ago.

7 Let's see if there is agreement on this -

8 approach. We will try to get Commissioner Gilinsky to 9 give us his separate views by tomorrow, and get 10 Commissionar Asselstine's separate views by tomorrow, 11 and allow until Monday for other Commissioners to review 12 them. If we have a problem on Monday, we will address 13 it.

14 COMMISSIONER ROBERTS: Fine.

15 COMMISSIONER AHEARNE: I think that it is 16 important to get the order out.

17 MR. H0YLE: We will get the word to his 18 office, Mr. Chairman.

19 CHAIRMAN PALLADINO: Is there any more we need 20 to do in the affirmation session?
