AFFIRMATION OF NRC EXEMPTION OF ANACONDA MINERAL COMPANY'S RH0DE RANCH URANIUM PROJECT FROM UMTRCA LAND 0WNERSHIP REQUIREMENTS In June 1981, NRC published a notice in the Federal Register granting an exemption from the land ownership transfer requirements of UMTRCA to Anaconda Copper Company in connection with their proposed Rhode Ranch project in Texas. The negative declaration issued in support of the action indicated that since the relevant provisions of the Atomic Energy Act, as amended, did not become effective until November 1981, it would be necessary for the staff to affirm the determination after the effective date of these provisions.
This memorandum constitutes affirmation of the subject exemption. No public notice of this action is considered necessary as it was previously noticed and is a discretionary action on the part of the Commission. As indicated in the negative declaration, NRC's determination applied only to the federal land ownership requirement. The State of Texas, as an Agreement State, has responsibility for licensing the proposed project.
