Dear Ms. Martin:
On. June 22, 1990, Rosemount Incorporated requested a Nuclear Regulatory -
Commission (NRC) license to authorize the export to the People's Republic of China of two' Alphaline Nuclear Pressure Transmitters.Model-1153DD5PB as u
replacements for transmitters originally shipped under a Department of Commerce export license on-September. 28, 1984, which were damaged..
The. application -
(XCOM1044) was referred to the Executive Branch for review according to.
procedures established under the Nuclear Non-Proliferation Act of 1978.
As' lead agency for the Executive Branch, the Department of State has informed the Commission that the necessary determination for a recommendation of approval under the Atomic Energy Act, as amended, cannot be made, and that the export'is-not permitted under P.L. 101-246.- The Executive Branch has therefore recommended 1
that the request for a license to export be denied.
i Under NRC regulations (10 CFR 110.44(d)),- the Commission will deny any export-license applicatinr. for which the Executive Branch judgment does not retemmend il approval... Accordingly, your apolication for-an export license is denied.
