NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:
Como Plastics, Inc. (EA 93-261)
Columbus, Indiana General License (10 CFR 31.5)
Subiect:
PROPOSED IMPOSITION OF CIVIL PENALTY - $750 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $750 will be issued to Como Plastics, Inc., of Columbus, Indiana on or about November 10, 1993.
This action is based on the improper transfer of two static eliminator devices each containing nominally 10 millicuries of polonium-210. The base civil penalty for a Severity Level III violation is $500.
The civil penalty was initially mitigated 50% for the licensee's corrective actions, but this was offset by 100% escalation for the licensee' poor performance (i.e.
five devices have been lost since July 1988.
On balance the civil penalty was increased 50%.

It should be noted that the licensee has not been specifically informed of the enforcement action.
