EN 93-109 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:

PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 will be issued on or about November 8, 1993, to Consumers Power Company.
This action is based on a breakdown in controls over significant plant activities at the Big Rock Point facility, as evidenced by (1) a breach in primary containment integrity while changing modes from Cold Shutdown to Refueling, and (2) exceeding the pressure limit while performing a hydrostatic test of the primary coolant system.
Note that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice November 8, 1993 Telephone Notification of Licensee November 8, 1993 The State of Michigan will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil l
penalty may be remitted, mitigated, or imposed by Order.
