A RESULT OF THE FINANCIAL ASSURANCE RULE This responds to your woorandum dated July 12, 1990, recommending-that fees not.be.larged '

a result of the financial assurance rule.

It is our understanding.that no health and safety review will be required for these amendments since ths licenses were written without a specified total possession limit due to:

NRC's'past licensing policy.

Since the quantity of radioisotopes actually-possessed under the 1.icenses is below the quantity requiring a decossissioning funding plan or financial assurance submittal, since=the licenses were written without a total-y possession limit as a result'of NRC' policy and not at the licensees' request, and since no health and safety review will be required to issue amendments to these licenses to incorporate a total possession limit, we-have determined that these amendments will be exempt from fesa. The exemption is authorized by law and is granted-in accordance with 9170.11(b)(1)of10CFR170.

This exemption will not apply.to applications for amendments to delete radioisotopes from-the license, lower a licensed possession. limit, or to establish a total possession limit-for any reason other than those stated above.
