i This is to advise you that the Commission has not objected to the I
staff plans to discuss the options presented in the subject paper with the Agreement States at the All Agreement State Meeting on October 24-27, 1993 provided the staff clearly states that the j
options are a staff proposal and that the Commission has neither i
reviewed nor approved the proposal.

The paper presents one option as a presumption of flexibility and
}
another option as a presumption of uniformity for purposes of l
determining compatibility with NRC regulations.
These two l
options need further development and would benefit from inclusion l
of examples of various aspects of the Agreement State programs under compatibility and how each example would be viewed under the two options.
In the proposed compatibility policy paper to i
be submitted to the Commission, the staff should make use of an appropriate number of examples, as needed to demonstrate each option.
