EN 94-002 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:

Docket No. 50-446 Subiect:
PROPOSED IMPOSITION OF CIVIL PENALTY - $25,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $25,000 will be issued on or about January 13, 1994 to Duke Power Company.
This action is based on the violations identified as a result of the followup of a steam leak in the Unit 2 containment on August 31, 1993.
The violations, which were caused by personnel error resulting from inadequate control of maintenance and operations activities, have been classified as a Severity l
l Level III problem.
A civil penalty of $25,000 has been proposed after mitigation of a total of 50% from the base civil penalty of
$50,000 for identification and corrective actions.
l It should be noted that the licensee has not been specifically l
informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice January 13, 1994 Telephone Notification of Licensee January 13, 1994 The State of North Carolina will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by order.
