This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty'in the amount of $187,500 will be issued on or about January 21, 1994 to Vermont Yankee

.1 Nuclear Power Corporation.

This action is based on the violations identified as a result of the followup of nuclear fuel handling incidents and the inoperability of the alternate cooling towerL.

The fuel handling violations were caused by failure to detect and' l

correct widespread procedure noncompliance during the movement of nuclear fuel.

The violations have been characterized as a Level III problem.

A civil penalty of $87,500 has been proposed after 25% mitigation from the base civil penalty of $50,000 for corrective actions and escalation of 100% for the multiple examples of procedure noncompliance.

l The inoperability of the alternate cooling tower was caused by failure to detect and correct the buildup of silt in the cooling 1

tower basin to above the service water system suction inlet.

The violation has been characterized as a Severity Level III violation.

A civil penalty of $100,000 has been proposed after 50% mitigation from the base civil penalty of $50,000 for identification, escalation of 50% for failure to implement prompt and comprehensive corrective actions, and escalation of 100% for failure to act after prior opportunities to identify the silting problem.

It should be noted that the licensee has not been specifically informed of the enforcement action.

The schedule of issuance and notification is:

Mailing of Notice January 1994 Telephone Notification of Licensee January 21, 1994 The State of Vermont will be notified.

The licensee has thirty days from the date ur the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
