(NRC INSPECTION REPORT NOS. 50-327/93-48 AND 50-328/93-48)

This refers to the inspection conducted by William J. Tobin of this office on
October 6-8, 1993. The inspection included a review of activities authorized
j
for your Sequoyah facility. At the conclusion of the inspection, the findings
1
were discusecJ telephonically on October 21, 1993, with those members of your
staff identified in the enclosed report.
Areas examined during the inspection are identified in the report. Within
these areas, the inspection consisted of selective examinations of procedures-
and representative records, . interviews with personnel, and observation of.
activities in progress.
The inspection findings indicate that certain activities appear to violate NRC
requirements. One of the apparent violations described in the enclosed
Inspection Report relates to the accuracy of your breath-alcohol testing as
l
required by 10 CFR Part 26, the NRC's Fitness For Duty Rule. This apparent
'
violation is undergoing review and consideration for further NRC action.
Accordingly, no Notice of Violation for this apparent violation is being
issued at this time. However, please be advised that the number and

characterization of the apparent violation described in the enclosed
inspection report may change as a result of further NRC review. You will be
advised'by separate correspondence of the results of our deliberations on this-
issue.
In addition to the apparent violation discussed above, inspection results
indicate that certain other of your activities appeared to be .in violation of
NRC requirements as specified in the enclosed Notice of Violation. We are
concerned about the enclosed violation because it demonstrates a weakness in
the procedures used-in your Fitness for Duty Program.
You are required to respond to this letter and should follow the instructions
specified in the enclosed Notice when preparing your response.

inspections, the NRC will determine whether further NRC enforcement action is
necessary to ensure compliance with NRC regulatory requirements.
Additionally, in your response you are requested to describe your efforts to

ensure the use of valid alcohol solutions during your breath-alcohol testing
'
as required by 10 CFR Part 26.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of

this letter and its enclosures will be placed in the NRC Public Document Room.
The responses directed by this letter and the enclosed Notice is not subject

to the clearance procedures of the Office of Management and Budget as required

by the Paperwork Reduction Act of 1980, Pub. L. No.96-511.
