Conversion Modification Project F-339," submitted _to the NRC contains proprietary information and requesting that it be withheld from public i
disclosure under 10 CFR 2.790(b)(1).
In the affidavit, you state that the i
subject criticality safety analysis contains information that should be r
withheld from public disclosure for the foilowing reasons:
1.
The information contained in the subject documents has been held in confidence by Siemens Power Corporation (SPC) pursuant to its internal policies.
j 2.
The cited information is the type of information that is normally held in confidence by SPC in order to protect it as a valuable trade secret i
which gives a competitive advantage to SPC and which information, if given to a competitor, would be valuable to such competitors, without them having to expend any funds and in allowing them to know what processes and equipment SPC is using.
3.
SPC has submitted the privileged and confidential information to the Commission in confidence.
4.
The information contained in the subject document has not been made available to public sources by SPC nor has SPC authorized that it be made available.

The public disclosure of the information contained in the document is likely to cause substantial economic harm to SPC.
On the basis of your submittal and in light of the requirements of 10 CFP.
2.790, we have determined that (i) the submitted information sought to be i
withheld contains privileged or confidential commercial information, and (ii) the document enclosed with your December 15, 1993, letter should be withheld j
from public disclosure pursuant to 10 CFR 2.790(b)(3).
Withholding from public inspection shall not affect the right, if any, of j
persons properly and directly concerned to inspect the document as provided j
for in 10 CFR 2.790(b)(6).

2-If, at any time in the future, the basis provided in your submittal for withholding any of the information from public disclosure should change such that the information could then be made available for public inspection, SPC should promptly notify the NRC.
SPC should also be aware that the NRC may.
have cause to review this determination in the future, such as in response to a Freedom of Information Act request that includes your information.
If, in reviewing this determination, the NRC determines to deny the request for withholding, SPC will be notified in advance of any public disclosure.
