On June 27, 1988,(53 FR 24018) the " General Requirements for Decommissio the U.S. Nuclear Regulatory Coinnission published in the-j Federal Register j
Nuclear Facilities." In accordance with these requirements and based on the quantities of material authorized by Materials License No. SNM-986,
' Massachusetts Institute of Technology (MIT) was required to submit financial assurance for decommissioning no later than July 27, 1990. As of this,date.
MIT has not done so. On several occasions and as recently as September 7, 1990, Dr. Sean Soong of ny staff discussed this matter with your.Mr. Frank Masse.
During their last" conversation, Dr. Soong was informed that MIT will evaluate this matter af ter September 23, 1990. Since MIT is not in compliance with NRC decommissioning requirements, we urge you to take appropriate action on this matter immediately. Enclosed for your information-is a copy of Regulatory Guide 3.66, " Standard Format and Content of Financial Assurance Mechanisms Required for Decommissioning under 10 CFR Parts 30, 40, 70, and 72."
