Dear Mr. Matthews:

Under a cover letter dated August 21,1990,.you submitted for NRC staff review draft responses to the open issues contained in the NRC Technical Evaluation Report (TER) on the proposed remedial action of the Rifle, Colorado Uranium MillTailingsRemedialAction(UMTRA)Projectsite.

The NRC staff completed their review of the proposed responses and our comments were provided to your i

staff during a conference call on September 13, 1990.

Of the eight open issues discussed in the TER, NRC agreed to DOE's aroposed responses for open issue nos.1, 3, 5, 6, and 7, while providing tecinical comments for DOE i

consideration for open issue nos. 2, 4, and 8.:

As discussed during the conference call, DOE should be aware that NRC agreement with proposed resolutions is subject to the NRC staff determination that the proposed resolutions have been adequately factored into the 'inal Remedial Action' Plan.
