Special Inspection No.93-014 - Reply to Notice of Violation

Dear Mr. Pasciak,

This is in response to your letter, dated 10/13/93, regarding the referenced inspection of Appleton Papers' facility in Harrisburg, Pennsylvania.

Harrisburg Plant management have taken steps to correct the violations noted in the NRC inspection and have independently advised the NRC of those actions. Purpose of this letter is to advise you of actions that I have taken and am taking to ensure that other affected facilities are in compliance.

My principal action was to communicate details of the inspection throughout Appleton Papers' operations by distribution of the NRC inspection notice to facility managers together with a copy of NRC regulations. A copy of this notice is attached.

To ensure understanding and adherence to requirements, I have requested that facility i

management (1) audit their operations for radiation sources located on-site and source management practices and (2) report their findings to me within 30 days. As an additional l

step. I am asking that members of my staff conduct an independent audit of facility management practices and records, related to radiation sources, in 1994 I believe that these actions will ensure that facility management are knowledgeable with regulatory license requirements and that they will continue to take steps to comply with those requirements. Please advise me if you feel that further actions are necessary or appropriate.

SUBJECT:

NRC AUDIT OF HARRISBURG PLANT On September 30, Nuclear Regulatory Commission' representatives conducted an inspection of the Harrisburg Plant for management of radiation sources located there.

They found three violations of regulatory requirements as noted in the attachment.

Purpose of this memorandum is to:

1.

Communicate details of the NRC inspection to all facilities (see attached copy of the inspection report)-

2.

Remind facility management of radiation source license requirements (see attached copy of the NRC Rule) 3.

Request facility audit of operations to evaluate compliance with regulatory requirements (where a radiation source is located on-site) 4.

Request a written report of audit results within 30 days Radiation sources such as those at the Harrisburg Plant are small and present no hazard to employees when used as required by NRC rules and manufacturer recommendations. Complete adherence to these rules and recommendations is required and expected.

If anyone has any questions regarding compliance requirements and/or actions, please call either of us for information and assistance.-
