VOGTLE ELECTRIC GENERATING PLANT REPLY TO A NOTICE OF VIOLATION Pursuant to 10 CFR 2.201, Georgia Power Company (GPC) submits the enclosed response to the violations identified in Inspection Reports 50-424/93-18 and 50-425/93-18 concerning the inspection conducted by Mr. R. F. Aiello during the period of November 29 through December 3,1993.

ENCLOSURE 1 VOGTLE ELECTRIC GENERATING PLANT - UNIT 1 & 2 REPLY TO A NOTICE OF VIOLATION EC INSPECTION REPORTS 50-424:425/93-18 The following is a transcription of the violation as cited in the Notice of Violation (NOV):
"10 CFR 55.25 states "If, during the term of the (an operator's) license, the licensee develops a physical or mental condition that causes the licensee to fail to meet the requirements of Q 55.21 of this part, the facility licensee shall notify the Commission within 30 days oflearning of the diagnosis. For conditions for which a conditional license (as described in Q 55.33(b) of this part)is requested, the facility licensee shall provide medical certification on Form NRC 396 to the Commission (as described in 55.23 of this part)." Also,10 CFR 50.74 states "Each (facility) licensee shall notify the Commission in accordance with Q 50.4 within 30 days of the following in regard to a licensed operator or senior operator:..(c) Disability or illness as described in Q 55.25 of this chapter."
Contrary to the above, on February 16,1993 the facility licensce's physician made the determination that an operator's license should have been conditioned "no solo" because the operator did not meet the standards specified above. Subsequently, the facility licensee failed to notify the Commission of the change in medical status of this operator within 30 days as required by 10 CFR 55.25 and 10 CFR 50.74.
This is a Severity Level IV violation (Supplement VII.D)."
ItESPONSE TO VIOI,ATION (50-424:425/93-18-01)
Adminion or Denini of the Viointion:
This violation occurred as stated in the notice of violation.
Itcason for the Violation:
This violation was attributed to a failure to follow procedural requirements for notifying the Commission when a licensed operator's medical condition changed. A_fler receiving a I
recommendation from the senior reactor operator's (SRO) personal physician that some work restrictions were appropriate, plant management transfered the SRO to a position which did not i
require him to perform licensed duties, and requested that the operators condition be evaluated by j
company medical staff. Since the SRO had been promptly transfered to the non licensed position, a thorough but routine evaluation of the individual's condition was completed. Involved personnel were not sensitive to the need to complete the evaluations and appropriate reports within the required time frame since the SRO was now in an inactive status.

VOGTLE ELECTRIC GENERATING PLANT - UNIT 1 & 2 REPLY TO A NOTICE OF VIOLATION NRC INSPECTION REPORTS 60-424:425/93-18 Corrective Steps Which Have Heen Taken and the Rcsults Achieved:
- 1. On November 18,1993, the Medical Director for Southern Nuclear issued a Physical Limitation Evaluation (PLE) for the involved licensed operator. The PLE indicated permanent restrictions due to an ongoing medical condition. The SRO had been previously re-assigned to non-licensed duties and placed on an inactive status due to reorganization within the Operations Department. Subsequently, GPC determined that the SRO no longer required a license and GPC submitted to the Commission a request for license termination on December 10,1993.
- 2. A thorough review of all licensed operator medical records was performed to ascertain if any other operators had PLEs that would necessita'e.wifying the Commission in accordance with 10 CFR 55.25. There were no other situations ~_ad that would require notifying the Commission.
- 3. Personnel responsible for ensuring that the requirements of 10 CFR 55 are met, have been informed of this violation and reminded of the procedural requirements for notifications in accordance with 10 CFR 55.25.
Corrective Steps Which Will Be Taken to Avoid Further Violations:
- 1. Any future PLEs will be thoroughly investigated for potential reportability per 10 CFR 55.25.
The Commission will be notified if any of the conditions set forth in 10 CFR 55.25 are met and notify the Commission within 30 days of the diagnosis.
- 2. A review of procedures will be performed to ensure that the process for notification in accordance with 10 CFR 55.25 is not compromised during any reviews oflicensed operator medical detenninations. If procedure revisions are necessary, they will be completed by March 1,1994.
Date When Full Compliance Will He Achieved:
Full compliance was achieved on December 10,1993, when correspondence (NOTS-01636) to the Commission was transmitted requesting termination of the subject individual's license.
