1 Commissioner Reaiok's Comments on SECY-90-256 I do not approve the' staff's proposal to publish the. notice of.

l proposed rulemaking on ERDS.

inspection have been shown to be justified.by the potential j

reduction in risk to the public under the backfit rule.

R I do not question that there are-advantages to ensuring that the most accurate and-timely information11s provided'to the NRC l

during an emergency in order to enable the staff lto better

' perform its monitoring role. I do not believe however, that the ERDS program is necessary-for ensuring this'information is available.

For example, no mention-is made that authority is transferred to the Regional' personnel on-site at the earliest j

l opportunity during an emergency, and that these individuals-havo l

access to accurate and timely information'at the site.

It may-be desireable for 100% of-licensees to have.the capability to electronically transmit emergency-information to the NRC operations Center,1but:before' requiring the NRC and industry:to j

incur the associated expense, I would.suggebt_that the program be j

i continued on a voluntary basis.and the need for a rule be reconsidered after several years of experience with the system-I L

have been gained.-.If experience demonstrates that there are significant public risk benefits, then I would be-more willing to!
