l JAN 141994 Docket No. 50-10 Docket No. 50-237 Docket No. 50-249 EA 93-223 Commonwealth Edison Company ATTN: Mr. M. J. Wallace Vice President, Chief Nuclear Officer Executive Towers West III 1400 Opus Place, Suite 300 Downers Grove, IL 60515
Dear Mr. Wallace:
SUBJECT:
NOTICE OF VIOLATION DATED NOVEMBER 26, 1993 This acknowledges receipt of your letter dated December 22, 1993, in response
'I to our letter dated November 26, 1993, transmitting a Notice of Violation involving an inadequate search which allowed a facsimile of a firearm to enter the protected area.
We note your concern regarding the composition (wood, plastic, etc) of facsimile firearms, and the potential enforcement precedence that may have been set by this case. The composition of the facsimile weapon in this case was not questioned.
Each enforcement action is evaluated based on.the circumstances of the specific case and is completed in accordance with the
" General Statement of Policy and Procedures for NRC Enforcement Actions."
Our concern is not with the composition of potentially undetected facsimile weapons but on the effectiveness of your search activities and plant protection. The appropriateness of our enforcement action in this case is reinforced by recent events. Specifically, a fully loaded 9nn semi-automatic pistol (partially made of plastic) was discovered by a security officer during an entry search at your LaSalle facility. The same search technique was used in both cases. One search worked and the other did not.
