Dear Mr. Sieber:

SUBJECT: NRC INSPECTION REPORT NOS. 50-334/93-22 AND 50-412/93-23

This refers to the inspection conducted by Messrs. L. Rossbach, P. Sena, S. Greenlee, and -

D. Lew of this office from September 28 to October 25,1993. The inspection included a

review of activities authorized for your Beaver Valley Power Station in Shippingport,

Pennsylvania. At the conclusion of the inspection, the findings were discussed with you and

other members of your staff.

Areas examined during the inspection are identified in the report. The inspection consisted

of document reviews, interviews, and observatior, of activities important to public health and

safety. The purpose of the inspection was to determine whether activities authorized by the -

license were conducted safely and in accordance wyh NRC requirements.

Based on the results of this inspection, one appa*ent violation was identified and is being

considered for escalated enforcement action in accordance with the " General Statement of-

Policy and Procedure for NRC Enfcicement Actions" (Enforcement Policy),10 CFR Part 2,-

Appendix C (1993). The apparent violation is that a temporary Unit 2 containment

penetration seal was not properly installed so as to provide closure equivalent to a closed

valve or blind flange. Your staff discovered air leaking from this penetration during fuel

transfer operations. A similar violation occurred during the previous Unit 2 refueling

outage. Accordingly, no Notice of Violation is presently being issued for these inspection

findings. In addition, please be advised that the number and characterization of apparent .

violations described in the enclosed inspection report may change as a result of further NRC

review.

An enforcement conference to discuss this apparent violation has been scheduled for

November 19, 1993. This enforcement conference will be open to public observation in

accordance with the Commission's trial program as discussed in the enclosed Federal

Register Notice (Enclosure 2). The purposes of this conference are to discuss the apparent

violation, its cause and safety significance; to provide you the opportunity to point out any

errors in our inspection report; to provide an opportunity for you to present your proposed

corrective action; and to discuss any other information that will help us determine the

appropriate enforcement action in accordance with the Enforcement Policy. In particular, we

expect you to address why previous corrective actions did not prevent recurrence and to what

extent the supplemental leakage collection and release system would have mitigated a release

from the penetration. In addition, this is an opportunity for you to provide any information

concerning your perspective on (1) the severity of the issue, (2) the factors that the NRC

considers when it determines the amount of a civil penalty that may be assessed in

accordance with Section IV. B. 2 of the Enforcement Policy, and (3) the possible basis for

exercising discretion in accordance with Section VII of the Enforcement Policy. You will be

advised by separate correspondence of the results of our deliberations on this matter. No

response regarding the apparent violation is required at this time.

Also, a non-cited violation was identified involving adherence to procedures. This violation

is not being cited because of its minor safety significance and your corrective actions.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter and

its enclosure will be placed in the NRC Public Document Room.
