Dear Mr. Wallace:

This refers to the routine safety inspection conducted by Messrs. H-Peterson,

C. H. Brown, J. Hansen, and Ms. V. P. Lougheed of this office from July 7

through September 30, 1993. The inspection included a review of activities at

your Byron Station, Units 1 and 2. At the conclusion of the inspection, the

findings were discussed with those members of your staff identified in the

enclosed report.

Areas examined during the inspection are identified in the report. Within ,

these areas, the inspection consisted of a selective examination of procedures

and representative records, observations, and interviews with personnel. i

Based on the results of this inspection, certain of your activities appeared  !

to be in violation of NRC requirements, as described in the enclosed Notice of

'

Violation (Notice). The first violation involved several examples of failure

to follow station procedures. This violation is of concern because on three . i

separate ocassions, equipment was unintentionally operated with the potential

for significant consequences. The second violation involved failure to follow

administrative procedures with respect to special plant procedures and

limiting condition for operation action requirements. This violation is of

concern because of the large number of errors that occurred over a seven year

period. As a result of these two violations, our concern over a potential

deteriorating trend in Byron Station performance is heightened. ..

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response. In your- ,

response, you should document the specific actions taken and any additional

actions you plan to prevent recurrence. After reviewing your response to this. ,

Notice, including your proposed corrective actions and the results of future-

inspections, the NRC will determine whether further NRC enforcement action'is

necessary to ensure compliance with NRC regulatory requirements.

Although 10 CFR 2.201 requires you to submit to this office, within 20 days of

your receipt of this Notice, a written statement of explanation, we note that

the second violation had been corrected and those actions were reviewed during

this inspection. Therefore, no response with respect to that violation is

required. J

Certain other of your activities, related to the security program, appear to

be in violation of NRC requirements. However, as described in the enclosed

inspection report, the violation was categorized at a Severity Level V and is _

not being cited because the criteria specified in Section VII.B of the

" General Statement of Policy and Procedures for NRC Enforcement Actions,"

(Enforcement Policy,10 CFR Part 2 Appendix C), were satisfied.

In accoroance with 10 CFR 2.790 of the Commission's regulations, a copy of

this letter, the enclosures, and your response to this letter will be placed

in the NRC Public Document Room. -

The responses directed by this letter and the accompanying Notice are not '

subject to the clearance procedures of the Office of Management and Budget as

required by the Paperwork Reduction Act of 1980, PL 96-511.

We will gladly discuss any questions you have concerning this inspection.
