- Regulation, has issued a decision concerning an Emergency Motion dated March 14, 1990, filed by Diane Curran, on behalf of Intervenors New England Coalition on

- Nuclear Po'.lution, Seacoast Anti-Pollution League, and the Comonwealth of Massachusetts. Intervenors argued that the NRC had no valid technical basis

^ for finding that the Seabrook reactor complies with the NRC's regulations and~

is safe to operate. The Motion was based on alleged recent, previously undisclosed industry reports of extensive and serious regulatory noncompliance at Seabrook.

- Accompanying the Motion was the affidavit of Robert Pollard and the Testimony

- of Mr. Po11hrd and Ralph Nadar presented before the Subcomittee on General:

-: 0versight and Operations, Comittee on Interior and Insular Affairs, U.S. House of_ Representatives.

In its Order of March 15, 1990, the Comission denied the Emergency Notion which sought an extension of the stay of full power operation set down by the Comission in its Memorandum-and Order of March 3,1990, authorizing issuance of.a full power-license (CLI-90-3). -r By' letter dated April 9,1990, the Director, Office of Nuclear Reactor Regulation acknowledged receipt of the Petition and notified Intervenors that.

action would be taken with respect to speci.1c issues raised in the Petition within'a reasonable' time.

The Director has determined that the Petition should be denied. The reasons for the denial are set forth in the Director's. Decision Under 10 CFR 2.206, DD 90-51ssued on August 31,1990, which is available for inspection l

and co;,ying in the Comission's Public Document Room, 2120 L Street, NW,

A copy of the Decision will be filed with the Secretary of the Comission  !

for the Comission's- review in accordance with 10 CFR 2.206(c). ' As provided in  ;
