NOTIFICATION TO CONGRESS CONCERNING THE COMMISSION'S DECISION TO ABOLISH THE ATOMIC SAFETY AND LICENSING APPEAL PANEL As we discussed yesterday, I request that my enclosed July 2, 1990, memorandum to Commissioner Curtiss (and the attached Appeal Board order in the Shoreham proceeding) be transmitted to the same members of Congress who were notified last month of the Commission's-decision to abolish

,the Atomic Safety and Licensing Appeal Panel.

In particular, I refer to your July 2, 1990, letters to Congressmen Udall and Sharp (with copies to Congressmen Hansen and Moorhead) and Senators Johnston and Graham (with copies to Senators Hatfield and Simpson), and Commissioner Rogers's July 3, 1990, letter to House-Speaker Foley.

Each of these letters tranrEitted-Commissioner Curtiss's June 13, 1990, memorandum setting forth his reasons for proposing the

. abolition of the Appeal Panel.

In the interest of fairness and a complete public record, the Commission should also transmit to all relevant Congressional committees and

-subcommittees my response to the Curtiss-memorandum.

In our conversation yesterday, you agreed to do so.

Enclosed, for.

your. convenience, are ten copies of my memorandum and attachment.

In turn, I would appreciate receiving a copy of~

the pertinent transmittal letters ~to-the Congress.
